This Refund Policy applies to Tickets sold by Moontower Media, LLC d/b/a Nxt Up Nation (“NXT UP,” “we,” “us,” or “our”) through tickets.nxtupnation.live and other NXT UP-authorized sales channels.

This Refund Policy should be read together with the NXT UP NATION Ticket Terms & Conditions.



1. All Sales Final
ALL TICKET SALES ARE FINAL AND NONREFUNDABLE EXCEPT WHERE REQUIRED BY APPLICABLE LAW OR EXPRESSLY AUTHORIZED BY NXT UP IN WRITING.
Except where required by law, Tickets may not be returned, exchanged, or redeemed for cash or credit.
Failure or inability to attend an Event does not create a right to a refund.
2. Event Cancellation
If an Event is cancelled in its entirety and is not rescheduled, NXT UP will provide any refund required by applicable law.
Where Nevada law requires a refund for cancellation of a covered live entertainment event, NXT UP will refund the full amount paid for the affected Ticket, including applicable fees and governmental charges, within the period required by law. Nevada law provides certain exceptions, including specified circumstances involving force majeure or extraordinary events beyond the ticket provider’s control. Nevada Legislature
Where applicable law does not require a refund, any refund, credit, replacement, or other remedy will be determined by NXT UP in accordance with the applicable Ticket Terms & Conditions.
3. Postponed, Rescheduled, or Relocated Events
If an Event is postponed, rescheduled, or relocated, the applicable Ticket may remain valid for the new date, time, or location.
A postponement, rescheduling, or relocation does not automatically create a right to a refund unless required by applicable law or expressly offered by NXT UP.
4. Changes to Event Programming
Changes to an Event do not automatically create a right to a refund.
This includes changes involving:
Performers.
DJs.
Celebrities.
Athletes or drivers.
Special guests.
Sponsors.
Programming.
Activities.
Schedules.
Race or qualifying schedules.
Hospitality elements.
Food or beverage offerings.
Viewing areas.
Event timing.
Other Event components.
5. Failure to Attend
Refunds will not be provided because of:
Change of plans.
Illness or personal circumstances.
Travel delays or cancellations.
Traffic.
Weather.
Late arrival.
Failure to obtain transportation or accommodations.
Failure to possess required identification or travel documentation.
Failure to meet age requirements.
Failure to satisfy applicable admission requirements.
Failure to use some or all benefits included with a Ticket.
Nothing in this Section limits rights that cannot lawfully be waived.
6. Denied Admission or Removal
A refund will not be provided where a Ticket holder is denied admission or removed from an Event because of:
Violation of Event or venue rules.
Failure to satisfy age or identification requirements.
Security concerns.
Fraud or Ticket misuse.
Unsafe or disruptive conduct.
Intoxication.
Unauthorized access.
Violation of applicable law.
Other grounds permitted under the Ticket Terms & Conditions or applicable law.
7. Multi-Part Tickets and Packages
Certain Tickets or packages may include multiple Event components, hospitality benefits, admissions, transportation, accommodations, merchandise, or third-party services.
If only one component is cancelled, changed, or becomes unavailable, the remaining components may continue to be valid.
Cancellation or unavailability of a single component does not automatically create a right to a refund of the entire Ticket or package.
Any refund required for an affected component will be provided in accordance with applicable law and the Ticket Terms & Conditions.
8. Third-Party Events and Services
Certain Ticket benefits may depend upon independent venues, sporting events, race organizers, hospitality providers, transportation providers, hotels, or other third parties.
NXT UP does not control the scheduling or operation of independent third-party events or services.
Any refund, replacement, credit, or other remedy relating to a third-party component is subject to applicable law and the provisions of the NXT UP Ticket Terms & Conditions.
9. Force Majeure
Events may be affected by circumstances outside NXT UP’s reasonable control, including severe weather, natural disasters, public emergencies, government action, transportation disruptions, venue closures, security incidents, sporting-event changes, and other force-majeure circumstances.
Refund rights in such circumstances will be determined under applicable law and the Ticket Terms & Conditions.
Nevada law expressly provides certain exceptions to its event-cancellation refund requirement for specified extraordinary or force-majeure circumstances. Nevada Legislature
10. Refund Method
Where a refund is required or approved, NXT UP will generally issue the refund to the original payment method where reasonably practicable.
Processing times after NXT UP issues a refund may vary depending on Stripe, the purchaser’s financial institution, card network, or payment provider.
NXT UP is not responsible for delays caused solely by a purchaser’s bank or payment provider after NXT UP has properly initiated the refund.
11. Chargebacks
A purchaser should contact NXT UP at hello@nxtupnation.live regarding a transaction concern before initiating a chargeback where reasonably practicable.
Initiating a chargeback does not create a right to a refund that does not otherwise exist.
NXT UP may provide applicable transaction records, Ticket Terms, delivery records, admission records, communications, and other relevant information to Stripe, TicketSocket, card issuers, banks, or payment networks in response to a payment dispute.
12. Controlling Terms
This Refund Policy summarizes NXT UP’s general refund practices.
The NXT UP NATION Ticket Terms & Conditions remain part of the agreement governing Ticket purchases and contain additional provisions relating to cancellations, postponements, Event changes, third-party services, force majeure, chargebacks, and liability.
If a mandatory provision of applicable law conflicts with this Refund Policy, the applicable law will control to the extent required.
